Copyright Policy (DMCA)
Avartan · avartan.ai · avartan.com.au — Effective date: 11 August 2026
Avartan respects intellectual-property rights and expects users to do the same. This policy describes how rights holders can report infringement and how we handle repeat infringers, consistent with the Digital Millennium Copyright Act (17 U.S.C. §512) and equivalent laws.
1. Scope
This policy covers content hosted on the Avartan Service (uploaded media, generated content stored in user libraries, media banks). Content published to third-party platforms (TikTok, Instagram, YouTube) should also be reported to those platforms via their own copyright processes, since we cannot remove content from platforms we do not control.
2. A Note on the Inspiration Library and Remixing
Our inspiration library displays links, thumbnails, and metadata of publicly available social content for reference. Our remix tooling is designed to create new content inspired by the structure and style of trends — not to reproduce specific works. If you are a creator and believe an Avartan user's content reproduces your work, or you want your content excluded from the inspiration library, contact us using the process below and we will review promptly.
3. Filing an Infringement Notice
Send a written notice to our designated agent containing:
- Identification of the copyrighted work claimed to be infringed;
- Identification of the infringing material and information reasonably sufficient to locate it (URLs, workspace/post identifiers, screenshots);
- Your contact information (name, address, telephone, email);
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law;
- A statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner;
- Your physical or electronic signature.
Designated Agent: Copyright Agent Innovation Engine Global Pty Ltd (ABN 94 668 670 675) 81-83 Campbell Street, Surry Hills NSW 2010, Australia Email: [email protected] (subject line: "DMCA Notice")
Misrepresenting that material is infringing can result in liability under 17 U.S.C. §512(f).
4. Our Response
On receipt of a valid notice we will promptly remove or disable access to the identified material, notify the user who posted it, and provide them a copy of the notice.
5. Counter-Notification
If your content was removed and you believe this was a mistake or misidentification, you may send a counter-notice to the designated agent including: identification of the removed material and its prior location; a statement under penalty of perjury of your good-faith belief the removal was mistaken; your name, address, and phone number; consent to the jurisdiction of the federal court for your district (or, if outside the US, any judicial district in which Avartan may be found) and acceptance of service from the complainant; and your signature.
If the complainant does not notify us within 10–14 business days that they have filed a court action, we may restore the material.
6. Repeat Infringers
We terminate the accounts of users who are repeat infringers in appropriate circumstances, and we may suspend accounts pending investigation.
7. Trademark and Other IP Complaints
For trademark, publicity/likeness, or other non-copyright IP complaints, email [email protected] with a description of the right claimed, proof of ownership/authority, and the location of the offending material. We review and act on these on a case-by-case basis.
